Personal data means any information relating to and concerning users that view the website. In particular, processing may involve the following personal data (hereinafter referred to as the “Data”):

Browsing data:during normal operation, the IT systems and software procedures used to run the Company’s website collect some personal data, which is implicitly transmitted through the use of Internet communication protocols. These data are only used to produce anonymous statistical information on the use of the website and to check that it is functioning correctly and are not associated with identified data subjects; however, due to their nature, and if integrated with third-party data, they could allow users to be identified. For example, this category of data includes the IP address used to access the website. These data are deleted from the systems once the statistical information has been processed and are stored off-line solely to ascertain liability in the event of cybercrimes and may only be accessed at the request of the judicial authority.

Personal data you provide on a voluntary basis: if you voluntarily send any emails to the email addresses on the website, your email address will be collected as will any other information included in the message; such personal data shall be used solely for the purpose of responding to your request.

Personal data provided in the Join the Team section: if you fill in the Join the Team form, your name, surname, town, telephone number and email address will be automatically collected so that your professional profile can be assessed.

Personal data collected when registering on/accessing the Private Area: if you register on the Private Area of the website, your name, surname, company name, position and email address will be collected so that you can use the services and content reserved for registered users. If you are already registered and access the Private Area, your username and password will be collected so that you can use the services and content reserved for registered users. You are responsible for safeguarding your username and password; the Company may not be held liable for any loss or disclosure of this data should you fail to exercise due caution or take adequate precautions while browsing online. 3. THE PURPOSES OF PROCESSING

The Company processes personal data for the following purposes:

  1. To respond to requests you submit to the Company;
  2. For aggregate and anonymous research and statistical analyses;
  3. To enable you to access services and content in the Private Area using the account provided by the Company;
  4. To evaluate an application for a job in the Company.

4. LEGAL BASIS FOR PROCESSING

Processing Data for the purposes set forth in 3), with the exception of d), has a legal basis in order to take steps at the request of the data subject prior to entering into a contract, and also, where applicable, for compliance with a legal obligation (Article 6(b) of the Regulation).
Express consent is a legal basis for processing Data for the purpose set forth in 3)(d).

5. DATA PROCESSING METHODS

For the purposes previously set forth in 3), the Data will be processed by automatic means in compliance with legislative provisions concerning personal data processing and with the appropriate security measures in place.
Data processing will be managed by suitably trained and experienced personnel to ensure appropriate security and confidentiality of the personal data, and also to prevent any risk of loss and/or destruction and access by unauthorised parties.

6. DISCLOSURE AND DISTRIBUTION OF DATA

Within the limits strictly related to the purposes previously set forth in 3), the Data may be disclosed to:

  • specifically authorised individuals within the Company that carry out activities connected with and instrumental in the management of the services that have been requested;
  • specifically appointed Processors (natural persons or entities that process data on documented instructions from the Company, such as for example a party appointed to manage and maintain the computer systems, etc.).

7. DATA STORAGE PERIOD

The Controller stores and process the Data for as long as necessary for the abovementioned purposes. The Data are then stored without further processing for the period of time set forth in current regulations concerning accounting and tax.
For the purposes previously set forth in 3)(d), any résumés and Data that have been collected are stored for twelve (12) months, unless consent is withdrawn as per 8).

8. RIGHTS OF THE DATA SUBJECT

With regard to your Data, you have the right to ask the Company for the following using the methods stated in the Regulation:

  • access, in the cases provided for in Article 15;
  • rectification of inaccurate personal data and the completion of incomplete personal data (Article 16);
  • the erasure of personal data where grounds apply (Article 17), such as when the personal data are no longer necessary in relation to the abovementioned purposes or the personal data have not been processed in compliance with the Regulation;
  • restriction of processing where circumstances apply (Article 18), such as when the accuracy of the personal data is contested and the accuracy of the personal data needs to be verified;
  • data portability, in the cases provided for in Article 20, namely the right to receive the personal data concerning you in a structured, commonly used and machine-readable format and the right to transmit those data to another controller; and
  • objection to processing, in the cases provided for in Article 21.

With regard to the purposes previously set forth in 3)(d), you also have the right to withdraw your consent at any time without affecting the lawfulness of processing based on consent before its withdrawal.

9. EXERCISING YOUR RIGHTS

If you wish to exercise the rights specified above, you can contact the Controller as follows:

The time period in which to reply is one (1) month, which may be extended to two (2) months in particularly complex cases; in such cases, the Company must at least provide intermediate information within one (1) month. In principle you can exercise your rights free of charge; the Company reserves the right to charge a fee if requests from a data subject are manifestly unfounded or excessive (and also repetitive). The Company has the right to request the provision of information necessary to confirm the identity of the person making the request.

10. COMPLAINTS

If you consider that the personal data processing infringes the provisions of the Regulation, you have the right to lodge a complaint with the supervisory authority for personal data protection as provided for by Article 77 of the Regulation.

11. PROVIDING DATA

Data must be provided so that we can deliver the services that have been requested.
Therefore, failure, even partial, to provide personal data means that we are objectively unable to proceed with your requests.
Providing consent for the use of personal data for the purposes previously set forth in 3)(d) is optional; failure to provide personal data means that we are objectively unable to evaluate your professional profile and proceed with any selection process to establish an employment relationship or a collaboration agreement.

12. DATA TRANSFER

Personal data are stored at the Controller’s headquarters and on servers in the European Union.

13. AUTOMATED DECISION-MAKING

The Data are not subject to profiling or to processing via automated decision-making.

14. LINKS TO OTHER WEBSITES

Some pages on the Website may contain links to other websites that are not managed by COLOR SYSTEM SPA. The Company does not share personal data with these websites. The Company is not responsible for the content, security or privacy measures used by other websites and expressly accepts no responsibility.

15. CHANGES TO THE PRIVACY NOTICE

This privacy notice applies to the Website when published. Changes may need to be made to the notice if new sector-specific regulations come into effect, or if warranted by the regular review and updating of the website’s terms and conditions of use.
